1. Scope
These General Terms and Conditions of Sale (hereinafter the “Terms”) apply to all product orders placed on www.aurema.co by a consumer.
They define the respective rights and obligations of Aurema and the customer, particularly regarding products, prices, orders, payment, production, delivery, the right of withdrawal, complaints, refunds and applicable statutory warranties.
Before confirming an order, the customer acknowledges having read and unconditionally accepted these Terms.
The applicable version is the one in force at the time the order is confirmed.

3. Products
Aurema offers a selection of artworks printed on canvas and produced on demand by its production partner after each order has been confirmed.
The essential characteristics of each product, including its visual appearance, dimensions, format and price, are presented on the relevant product page.
Photographs, descriptions and representations are prepared with the greatest care to accurately reflect the products offered. However, slight differences in color may occur between the display on a screen and the final printed result, particularly due to screen settings and the printing process.
If the delivered product differs significantly from its description or presents a lack of conformity, the customer may contact Aurema to exercise the rights provided by applicable law.
Aurema reserves the right to modify, replace or remove a product from its catalogue at any time. Such changes have no effect on orders that have already been confirmed.
4. Prices, Taxes and Import Charges
The applicable prices are those displayed on the website at the time the order is confirmed, in the currency offered to the customer.
As Aurema benefits from the VAT exemption scheme, VAT is not applicable in accordance with Article 293 B of the French General Tax Code.
Before final confirmation of the order, the total amount payable is shown to the customer. It includes the price of the products and any applicable delivery charges.
Aurema reserves the right to change its prices at any time. However, the prices applied to an order remain those displayed when the order was confirmed.
Standard shipping is free for orders delivered to eligible destinations within the European Union.
For orders shipped outside the European Union, delivery charges may apply. Their amount is communicated before final confirmation of the order.
Depending on the destination country, customs duties, import taxes or processing fees may also be charged by local authorities. Unless otherwise stated at checkout, these charges are not included in the amount paid to Aurema and remain the responsibility of the recipient.
5. Ordering Process
Before confirming an order, the customer is invited to carefully check:
- the selected artwork;
- the format and dimensions;
- the quantity ordered;
- their contact details;
- their email address;
- their delivery address;
- the total amount of the order.
The customer may correct the information entered before final confirmation of the purchase.
The order becomes binding after payment has been validated and the order has been confirmed by Aurema, subject to the rights available to consumers under applicable law.
An order confirmation is sent to the email address provided by the customer when making the purchase.
Aurema reserves the right to suspend or cancel an order, particularly in the event of payment refusal, reasonable suspicion of fraud, an obvious pricing error or information preventing the proper fulfilment of the order.
6. Payment
Payment is due when the order is confirmed.
The available payment methods are those offered to the customer at checkout.
Transactions are processed securely by the payment service providers available on the website. Aurema does not have access to the customer's complete banking information.
Production of the order begins after payment has been confirmed.
If payment is refused or fails, the order cannot be fulfilled.
7. On-Demand Production
Aurema products are printed on demand after the order has been confirmed.
Production generally takes 2 to 5 business days, excluding weekends and public holidays.
This timeframe may exceptionally be extended, particularly during periods of high activity or where additional verification is required.
The use of on-demand printing means that production begins quickly after the order is confirmed.
8. Delivery
Aurema currently delivers to countries indicated as eligible during checkout.
Estimated delivery times, including production, are generally:
Metropolitan France and European Union: 7 to 15 business days.
United Kingdom, Switzerland, Norway and Liechtenstein: 7 to 25 business days.
United States, Canada and Australia: 7 to 25 business days.
These timeframes are estimates and may vary depending on the destination, carrier, time of year, customs formalities or other circumstances affecting transportation.
When several products are ordered at the same time, they may be shipped separately and delivered on different dates.
Where applicable regulations provide for a maximum delivery period and no other date has been agreed, the statutory provisions relating to delivery remain fully applicable.
The customer is responsible for the accuracy and completeness of the delivery address provided when placing the order.

9. Tracking, Delay and Loss of a Parcel
Where tracking is available, a tracking link or number is provided to the customer after the order has been shipped.
In the event of a delay, the customer is invited to check the available tracking information and contact Aurema if the order has still not arrived after the estimated delivery date.
Aurema will then carry out the necessary checks with its production partner and/or the carrier.
Where a parcel appears to be lost, Aurema may submit a claim to the relevant parties.
If the loss is confirmed, Aurema will offer the customer a solution consistent with their rights, including a free replacement or refund depending on the circumstances.
Where tracking indicates that the parcel has been delivered but the customer states that it has not been received, checks may be carried out with the carrier before the complaint is resolved.
10. Right of Withdrawal
In accordance with the applicable provisions of the French Consumer Code, consumers are generally entitled to a 14-day period from receipt of the goods to exercise their right of withdrawal without having to provide a reason.
The fact that a canvas is “printed on demand” does not, in itself, remove the statutory right of withdrawal.
However, in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal may in particular be excluded for goods made to the consumer's specifications or clearly personalized, where the legal requirements for this exception are actually met.
To exercise the right of withdrawal, the customer must notify Aurema of their decision before the applicable period expires, by means of an unambiguous statement or by using the standard withdrawal form provided.

Where the right of withdrawal applies, the customer then has 14 days from the date on which their decision to withdraw is communicated to return the product in accordance with the instructions provided by Aurema.
Unless otherwise provided by law or Aurema announces that it will cover them, the direct return costs remain the customer's responsibility.
The product must be returned in a condition allowing it to be resold. The customer may be held liable for any decrease in value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.
11. Refund in the Event of Withdrawal
Where the right of withdrawal is validly exercised, Aurema refunds the amounts due in accordance with the provisions of the French Consumer Code, including, where required by law, the standard delivery charges initially invoiced.
The refund is made using the same payment method used for the original transaction, unless the customer expressly agrees to another method, provided that it does not result in any additional costs.
Aurema may withhold the refund until the goods have been recovered or until the customer provides proof that they have been dispatched, in accordance with applicable legal provisions.
12. Cancellation or Modification Before Shipment
As orders are quickly sent into production, customers are invited to contact Aurema as soon as possible if they wish to request a modification or cancellation.
Aurema will do its best to accommodate the request where production has not yet begun.
Where the order has already entered production, it may no longer be technically possible to modify or cancel it.
This provision does not deprive consumers of the mandatory rights available to them under applicable law, including the right of withdrawal where applicable.
13. Damaged, Defective or Incorrect Product
If an order arrives damaged, has a defect or does not correspond to the product ordered, the customer is invited to contact Aurema at:

- their order number;
- a description of the problem;
- one or more photographs of the product concerned;
- a photograph of the packaging where the damage appears to be related to transportation.
These elements help speed up the processing of the complaint but do not limit the consumer's exercise of statutory warranty rights.
After verification, Aurema will offer the appropriate solution in accordance with the consumer's rights.
14. Statutory Warranties
Products sold by Aurema benefit from the applicable statutory warranties, including the legal guarantee of conformity provided for by Articles L.217-3 et seq. of the French Consumer Code and the warranty against hidden defects provided for by Articles 1641 et seq. of the French Civil Code.
Under the conditions provided by law, consumers may in particular obtain the conformity of the goods through repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract.
The legal guarantee of conformity applies independently of any commercial warranty that may be offered by Aurema.

In accordance with the provisions of the French Consumer Code concerning consumer dispute mediation, after contacting Aurema and in the absence of a satisfactory response, consumers may use the following consumer mediation service free of charge:

Use of the mediator is free of charge for consumers.
Mediation may in particular only be initiated after the consumer has first attempted to resolve the dispute directly with Aurema, in accordance with the conditions provided by the French Consumer Code.
17. Liability
Aurema is responsible for the proper performance of its obligations under the conditions provided by applicable law.
Nothing in these Terms may exclude or limit the mandatory rights granted to consumers by law.
However, Aurema shall not be held liable for non-performance resulting from a force majeure event meeting the conditions laid down by French law.

Personal data necessary for processing orders and managing customer relations is processed in accordance with applicable personal data protection regulations.

Elements available on www.aurema.co, including texts, logos, photographs, visuals, illustrations, graphic creations and other content, are protected by intellectual property rights to the extent that Aurema holds the relevant rights or has the necessary authorization to use them.
Any unauthorized reproduction, representation, adaptation or exploitation is prohibited under the conditions provided by applicable law.
20. Applicable Law and Disputes
These Terms are governed by French law.
In the event of a dispute, the customer is invited to contact Aurema in order to seek an amicable solution.
Consumers may also use the consumer mediator referred to in Article 16 of these Terms where the required conditions are met.
If no amicable solution is reached, the dispute may be brought before the competent courts in accordance with applicable legal rules.
Nothing in these Terms deprives a consumer residing in another country of any mandatory protections to which they may be entitled under applicable law.
21. Amendments to the Terms
Aurema may amend these Terms, in particular to reflect legislative, regulatory or technical developments or changes to its services.
Amendments do not apply retroactively to orders that have already been concluded.
The version applicable to an order is the version made available to the customer at the time the order is placed.
