1. Purpose

These Terms of Use govern access to www.aurema.co, its use, and the services offered by Aurema.

By accessing our website or placing an order, you acknowledge that you have read these terms and agree to be bound by them without reservation.

If you do not agree to these terms, please do not use our services.

Purchases made on the website are also subject to the General Terms and Conditions of Sale applicable at the time of the order.

2. Access to the Website and Use of Services

Access to www.aurema.co is free of charge. Any costs relating to Internet access or computer equipment remain the responsibility of the user.

Aurema makes every effort to ensure the accessibility of the website, but cannot guarantee continuous operation free from interruptions or errors.

Aurema cannot be held liable for temporary unavailability of the website, particularly in the event of maintenance, technical failure or an event beyond its control, subject to any applicable mandatory legal provisions.

The user undertakes to use the website in accordance with applicable laws and regulations.

Any fraudulent, abusive or unlawful use, or any use that infringes the rights of Aurema or third parties, may result in suspension or restriction of access to the website, without prejudice to any other available remedies.

3. Products and Services

The artworks offered on www.aurema.co are printed on demand after the order has been confirmed.

Aurema reserves the right to modify, replace or remove any product, collection or website content at any time.

Such changes have no effect on orders that have already been concluded.

Photographs, illustrations and descriptions are presented with the greatest care in order to accurately reflect the products offered.

However, slight differences in color or appearance may occur, particularly due to screen settings and the specific characteristics of the printing process.

A slight difference in appearance does not necessarily constitute a lack of conformity.

However, this provision does not deprive consumers of their rights where the product actually presents a lack of conformity within the meaning of applicable regulations.

4. Orders and Processing

Any confirmed order is forwarded to our production partner to be printed, prepared and then shipped.

The customer is responsible for the accuracy of the information provided when placing the order, particularly regarding:

  • the selected artwork;
  • the format;
  • the quantity;
  • the delivery address;
  • the email address;
  • any other contact details necessary to fulfil the order.

The customer is invited to carefully check this information before finally confirming the order.

Due to our on-demand printing model, production may begin quickly after the order has been confirmed.

An order may therefore no longer be modifiable or cancellable once production has started.

Customers are invited to contact Aurema as soon as possible at support@aurema.co if they wish to request a modification or cancellation.

This operational inability to modify or cancel an order once production has begun does not deprive consumers of their statutory right of withdrawal where that right applies.

Detailed provisions relating to orders, payments, deliveries and consumer rights are set out in the General Terms and Conditions of Sale.

5. Right of Withdrawal

Where applicable regulations provide for it, consumers have a period of 14 days from receipt of the goods to exercise their right of withdrawal without having to provide a reason.

The fact that a product is printed on demand does not automatically remove this right where it corresponds to a standard model offered in our catalogue.

However, the right of withdrawal may be excluded in certain cases provided by law, particularly for goods made to the consumer's specifications or clearly personalized.

6. Intellectual Property

All content available on www.aurema.co, including artworks, photographs, illustrations, texts, logos, graphic elements, videos and other content, is protected by applicable intellectual property laws.

Such content remains the property of its respective rights holders.

Unless prior written authorization has been obtained or an exception is provided by law, any reproduction, representation, distribution, modification, adaptation or exploitation, in whole or in part, of content belonging to Aurema is prohibited.

Any unauthorized use may result in liability under applicable law.

7. Limitation of Liability

Aurema endeavors to ensure the accuracy and updating of the information published on its website.

However, despite the care taken in preparing such information, some information may contain errors or become temporarily outdated.

To the extent permitted by applicable law, Aurema shall not be held liable for indirect damages resulting from the use of the website or temporary inability to access it.

Nothing in these Terms of Use shall exclude or limit Aurema's liability where such liability cannot legally be excluded or limited.

Mandatory consumer rights remain fully applicable.

8. Protection of Personal Data

Personal data collected when using the website or placing an order is processed in accordance with our Privacy Policy and applicable regulations, including the General Data Protection Regulation (GDPR).

Subject to the conditions laid down by applicable regulations, you may in particular have the right to:

  • restriction of processing;
  • data portability;
  • withdrawal of your consent where processing is based on consent.

10. Amendments to These Terms

Aurema reserves the right to amend these Terms of Use, particularly in order to reflect legislative, regulatory or technical developments or changes to its services.

The new terms enter into force upon publication on the website.

Amendments to these Terms of Use do not retroactively modify the contractual terms applicable to orders that have already been concluded.

11. Applicable Law and Dispute Resolution

These Terms of Use are governed by French law, subject to any mandatory provisions that may apply to consumers.

Aurema will prioritize seeking an amicable solution.

After submitting a written complaint to Aurema, if no satisfactory response is received or no amicable agreement is reached, the consumer may use, free of charge, the consumer mediator to which Aurema belongs:

Submit a dispute to CM2C

Use of the mediator is free of charge for the consumer.

If no amicable solution or mediation is reached, the dispute may be brought before the competent courts in accordance with applicable legal rules.

12. Force Majeure

Aurema shall not be held liable for any delay or inability to perform all or part of its obligations where the situation results from an event meeting the legal conditions of force majeure.

The consequences of a force majeure event are determined in accordance with applicable law.
